These Terms & Conditions ("Terms") govern your access to and use of the website www.aquainwent.com (the "Website") and any products, services, quotations or communications provided by Aquainwent LLP ("Aquainwent", "we", "us" or "our"). By accessing the Website, submitting an enquiry, or purchasing our products or services, you agree to be bound by these Terms. If you do not agree, please do not use the Website.
By using the Website or engaging with Aquainwent for any product or service, you confirm that you have read, understood and agree to these Terms, along with our Privacy Policy, which is incorporated herein by reference. These Terms apply to all visitors, customers, business partners and other users of the Website.
The Website and our Products and Services are intended primarily for businesses (hotels, restaurants, cafés, cloud kitchens, institutions and similar commercial establishments) and for trade partners. You must be at least 18 years of age and capable of entering into a legally binding contract to use the Website or place an order.
You agree to provide accurate, current and complete information when submitting an enquiry, assessment request or order, and to keep such information updated.
Aquainwent is an authorized importer and distributor of Everpure by Pentair commercial water filtration solutions in India. We supply, install and service Products and provide related Services across India through our own team and authorized partners.
Product descriptions, specifications, images and capacities shown on the Website are for general information and may be updated by the manufacturer or by us without notice. The suitability of a particular Product depends on your specific water quality and application; final recommendations are provided following a site assessment.
Payment terms will be specified in the applicable quotation, invoice or order confirmation. Unless otherwise agreed in writing, payment is due as per the invoice terms. Aquainwent reserves the right to withhold delivery, installation or service in the event of non-payment or overdue amounts. Title to Products passes to the Customer only upon full payment; risk passes on delivery.
Delivery and installation timelines are estimates and are subject to stock availability, site readiness and factors beyond our reasonable control. The Customer is responsible for ensuring the installation site is ready, accessible and meets the technical pre-requisites communicated by Aquainwent (including suitable plumbing, electrical supply, space and water source). Delays caused by site un-readiness may result in rescheduling and additional charges.
Products are covered by the applicable manufacturer's warranty (where provided by Pentair/Everpure or the relevant manufacturer) and/or the warranty stated in your order documentation. Warranty coverage is subject to correct installation, use of genuine cartridges and consumables, recommended maintenance, and the warranty terms and exclusions of the manufacturer.
Consumable items (such as filter cartridges) and damage caused by misuse, neglect, unauthorized servicing, non-genuine parts, or unsuitable water conditions are not covered. Annual Maintenance Contracts (AMC), where purchased, are governed by the separate AMC terms provided to you.
As Products are commercial equipment often supplied and installed to order, cancellations, returns and refunds are handled on a case-by-case basis and as set out in your order confirmation. Custom, special-order or installed items may not be returnable. Any approved returns must be unused, in original packaging and subject to applicable charges. Please contact us promptly regarding any defect or discrepancy on delivery.
Applications submitted through our Dealer Onboarding page are for business entities only. Submitting an application does not guarantee appointment as a dealer or partner. Appointment is at Aquainwent's discretion, subject to verification and the execution of a separate partnership agreement which will govern that relationship.
All content on the Website — including text, graphics, logos, images, layouts and design — is the property of Aquainwent or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute or create derivative works without our prior written consent.
Everpure® and Pentair® are trademarks of their respective owners and are used in accordance with our authorized distributor relationship. All other trademarks, brand names and logos appearing on the Website are the property of their respective owners.
You agree not to use the Website for any unlawful purpose, to disrupt or interfere with its security or functionality, to attempt unauthorized access, to scrape or harvest data, or to submit false, misleading or harmful information. We reserve the right to restrict or terminate access for any breach of these Terms.
The Website may contain links to third-party websites (including the Pentair store locator and verification page) provided for your convenience. We do not control and are not responsible for the content, accuracy or practices of third-party sites, and inclusion of a link does not imply endorsement.
The Website and its content are provided on an "as is" and "as available" basis. While we strive for accuracy, we make no warranties or representations, express or implied, regarding the completeness, reliability or availability of the Website or its content. Any reliance you place on such information is at your own risk. Product performance depends on correct selection, installation, maintenance and water conditions.
To the maximum extent permitted by law, Aquainwent shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data or goodwill, arising out of or in connection with your use of the Website, Products or Services. Our total aggregate liability for any claim shall not exceed the amount paid by you for the specific Product or Service giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
You agree to indemnify and hold harmless Aquainwent, its directors, employees and partners from and against any claims, damages, liabilities, costs and expenses arising out of your breach of these Terms, your misuse of the Website, or your violation of any law or the rights of a third party.
Your use of the Website and submission of personal data are governed by our Privacy Policy, which explains how we collect, use and protect your information in accordance with applicable Indian data-protection law, including the Digital Personal Data Protection Act, 2023. By using the Website, you consent to such processing.
Aquainwent shall not be liable for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, government actions, strikes, supply-chain disruptions, transport delays or utility failures.
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts at Mumbai, Maharashtra, India.
